Agreeing to these terms
These Terms of Service are an agreement between you and Staged (“Staged,” “we,” “us”), a Missouri limited liability company, covering your use of joinstaged.com, the Staged mobile apps, and everything else we run (together, the “Service”).
By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Staged.
You must be 18 or older
Staged is only for adults. You must be at least 18 years old, and able to form a binding contract, to create an account or book or perform through the Service. When you sign up you confirm that you are.
We don't knowingly collect personal information from anyone under 18, and never from children under 13. If we learn an account belongs to someone under 18, we'll close it and delete its information. If you believe that's happened, tell us at hello@joinstaged.com.
Your account
You're responsible for the information in your account being accurate, for keeping your password secure, and for everything that happens under your account. Let us know right away if you think someone else has access to it.
One person, one account. You can't create an account for someone else without their permission, or impersonate anyone.
What Staged is (and isn’t)
Staged is a marketplace. We connect people booking entertainment (“Customers”) with independent performers (“Stars”), and we handle discovery, messaging, and payment. When a Customer books a Star, the agreement to perform is between the Customer and the Star.
Stars are independent businesses, not Staged employees or agents. We review Star applications before they go live, but we don't guarantee any Star's performance, conduct, or suitability for your event, and we don't control how a performance goes on the day.
Bookings, fees, and payment
- The Staged fee. Staged adds a 6% fee on top of a Star's rate, paid by the Customer. The same 6% is added on top of any tip. It is never taken out of what a Star quoted or what a Customer tipped.
- Payment is held until the event. Customers pay through Stripe when a booking is confirmed. The money is held and only released to the Star after the event, either when the Customer confirms it or automatically two hours after the event ends if the Customer doesn't report an issue.
- One-time charges only. Staged doesn't sell subscriptions. Every charge is a single payment for a specific booking or tip, shown to you in full before you pay.
- Stripe. Payments and Star payouts are processed by Stripe. Stars must complete Stripe's own onboarding, and everyone using payments agrees to Stripe's terms as well as ours.
Don't arrange to pay or get paid outside Staged for a booking you found through Staged. It takes away the payment protection both sides rely on.
Cancellations and refunds
If a Customer cancels, the refund depends on how close it is to the event's start:
- 72 hours or more before the event: a full refund.
- Less than 72 hours before the event: a 50% refund.
- After the event has started: no refund.
If a Star cancels, the Customer gets a full refund whenever it happens, and the cancellation counts against the Star's reliability record. The exact refund amount is always shown on the cancellation screen before you confirm.
If something goes wrong at the event, use Report an issue instead of confirming the booking. That holds the funds while we review it with both sides. Our decision on how held funds are released or refunded is final as far as the Service goes, but it doesn't affect any rights you have against the other party.
If you’re a Star
- You're responsible for your own performances, equipment, permits, and taxes. Staged may send you tax forms (such as a 1099-K) through Stripe where the law requires it.
- Your profile, pricing, and availability have to be accurate, and you're expected to honor bookings you accept.
- If you're a Group Admin, you confirm you're authorized to book and set payout splits on behalf of everyone in your group's lineup.
- Verification details you give us, like a government ID, are used only to review your application.
Content you post
You keep ownership of the photos, videos, bios, reviews, messages, and anything else you post on Staged. By posting it, you give Staged a non-exclusive, royalty-free, worldwide license to host, display, and share it for the purpose of running and promoting the Service, such as showing your Star profile on the Browse page. The license ends when you delete the content or your account, except for copies we must keep by law or that others have already shared.
Only post content you own or have permission to use. That includes the music in your performance videos and any photos taken by someone else. If you believe something on Staged infringes your copyright, email hello@joinstaged.com with a link to it and we'll review it.
Things you can’t do
- Harass, threaten, or discriminate against anyone you meet through Staged.
- Post anything false, misleading, illegal, or that you don't have the rights to.
- Use Staged to contact people for anything other than bookings, including spam.
- Scrape the Service, probe it for vulnerabilities without our permission, or interfere with how it runs.
- Leave reviews for bookings that didn't happen, or pay for or trade reviews.
We can remove content or suspend or close accounts that break these rules.
Disclaimers and limits of liability
The Service is provided “as is” and “as available.” To the fullest extent the law allows, Staged disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent the law allows, Staged isn't liable for indirect, incidental, special, consequential, or punitive damages, or for anything that happens between a Customer and a Star at or around an event. Our total liability for any claim relating to the Service is limited to the greater of the Staged fees you paid us in the 12 months before the claim, or $100.
Some places don't allow these limits, so they may not all apply to you.
Closing your account
You can close your account at any time by contacting us. We may suspend or close an account that breaks these terms or puts other people at risk. Bookings that are already paid for are settled under the cancellation policy above.
Changes to these terms
We may update these terms as Staged changes. If a change is significant, we'll let you know by email or in the app before it takes effect. Continuing to use Staged after that means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules. Any dispute that isn't resolved informally will be handled in the state or federal courts located in St. Louis, Missouri.
